Requesting specific documents or rejecting valid ones can be considered document abuse, a form of discrimination under the Immigration and Nationality Act (INA). Employers should not require more or different documentation than what is legally necessary, as this can lead to unfair treatment based on citizenship status or national origin. Employers must also apply these verification procedures consistently to all employees, regardless of their background. Ensuring proper training on I-9 procedures helps employers avoid unintentional discrimination while maintaining compliance with employment eligibility verification laws.

While participation in E-Verify is voluntary at the federal level, many states have enacted laws mandating its use to ensure a legal workforce. 

States Requiring E-Verify 

As of now, 23 states have implemented requirements for certain employers to use E-Verify. The specifics of these mandates vary: 

  • All Employers: States like Alabama, Arizona, Florida, Georgia, Louisiana, Mississippi, North Carolina, South Carolina, Tennessee, and Utah require all or most businesses to use E-Verify when hiring new employees.  
  • Public Employers Only: States including Colorado, Idaho, Indiana, Michigan, Minnesota, Missouri, Nebraska, Oklahoma, Pennsylvania, Texas, Virginia, and West Virginia mandate E-Verify usage primarily for public employers.  
  • Local or Municipal Requirements: Certain local jurisdictions within states like Colorado (e.g., Denver) and Florida (e.g., Hernando County) have their own E-Verify mandates for contractors and subcontractors.  

States Without E-Verify Mandates 

Conversely, several states have not enacted any E-Verify requirements, leaving participation voluntary for employers. However, this landscape is dynamic, with legislative proposals continually emerging. Employers are advised to stay informed about potential changes in their respective states.
